String of Dog Bite Attacks in Southern California Claims Another Life

The death of a toddler after a dog bite attack on Thursday evening, May 27, brought the total of Southern California dog attacks on children to six in just as many months of 2010, with two of those attacks ending in fatality.

In the latest incident, a family pit bull mauled a 2-year old toddler while he played in the backyard of the family’s home in San Bernardino. The 2-year old suffered extensive head and neck wounds. He passed away approximately six hours later at the Loma Linda University Medical Center. The reason or provocation for the mauling is unknown.

The first fatality from a dog attack in Southern California was in January when a family pit bull attacked a 3-year old. In February, a pack of dogs attacked three children in Fontana, seriously injuring all three. In April, a friend’s dog attacked a six-month old boy in Riverside County as he sat in a child carrier at the home of his mother’s friends.

Dog Bites Maim 6-Month-Old Baby in Attack

A six-month-old baby boy’s testicles were severed recently when two dogs attacked him as he lay unattended in a baby carrier on the floor in a Murrieta apartment. The boy and his mother were at a friend’s apartment when a five-year-old pit bull and an eight-month-old pit bull mix attacked. According to the mother, the baby had been in the carrier for ten minutes. She said she had checked on him once, and he was fine, but approximately three minutes later, she heard the baby screaming and ran to the room to find that her friend’s dogs had ripped off the boy’s diaper and bitten the baby in the groin area.

The baby went to Rancho Springs Medical Center in Murrieta for treatment, and the dogs were euthanized. Pit bulls have been banned in some cities, but the State of California has taken a different approach. Instead of banning pit bulls and other breeds of dogs with reputations for aggressiveness, the state penalizes the owners of dangerous dogs. California Dog Bite Laws Place Strict Liability on Dog Owners

A person is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner.”

Under California Civil Code § 3342.5:

“The owner of any dog that has bitten a human being shall have the duty to take such reasonable steps as are necessary to remove any danger presented to other persons from bites by the animal.”
